Probate - Jersey domiciled persons
Probate is the legal process of settling the estate of a deceased person, specifically resolving all claims and distributing the deceased person’s property under the terms of the valid Will.
“Letters of Administration” is the legal process of settling the estate of a deceased person where no Will exists.
UK domiciled persons – Jersey Grant of Probate / Fast Track
If a person holding assets in Jersey in his or her own name dies whilst domiciled in the UK (England and Wales, Scotland, Northern Ireland, Guernsey and the Isle of Man), and a UK Grant of Probate has been obtained, a Fast Track system for gaining a Jersey Grant of Probate (or Letters of Administration) is available.
Persons domiciled outside Jersey and the UK
If the deceased was domiciled outside Jersey and the UK, the Fast Track process is not available. In this case, a Jersey Grant of Probate (or Letters of Administration) is applied for once the necessary documents have been received from the deceased’s lawyers.
